In certain cases, LEOs have the discretion to either arrest you or issue you a Notice to Appear (“NTA”). An NTA may resemble a “ticket,” but it is a legal document that requires your appearance in court for an arraignment. Failure to appear possibly results in a warrant being issued for your arrest.

Note that LEOs and police sometimes make arrests or issue NTAs with minimal evidence of probable cause. However, our experience and training at HJP Legal have equipped us with the skills to challenge such a lack of evidence and advocate for the case to be reduced or dropped by the prosecutor. If you believe the misdemeanor charges against you lack such merit, contact Halley J. Peters of HJP Legal at (949) 340-0102 for a complimentary consultation.

In many misdemeanor cases, different parties involved may have varying opinions on the significance of the events. Sometimes, individuals may mistakenly call the police with the intention of temporarily removing someone from a location or seeking law enforcement assistance as an intermediary between two parties.

Note that the primary duty of Law Enforcement Officers (“LEOs”) is to investigate crime, which can often result in an arrest, regardless of the intentions of the 911 caller. If an LEO believes that there is probable cause for an arrest, they are likely to proceed with it. For a thorough evaluation of your case, you need to retain the representation of a criminal defense attorney skilled in defending misdemeanors and felonies alike.
